The EB-1 visa (Employment-Based First Preference) is a premier pathway to a U.S. Green Card for individuals at the very top of their fields.  


As one of the highest-priority employment-based immigrant categories administered by U.S. Citizenship and Immigration Services (USCIS), the EB-1 offers significant advantages, including no requirement for labor certification (PERM) and often faster processing times compared to other employment-based options. 


This visa is reserved for "priority workers" who demonstrate exceptional talent, leadership, or executive experience. It is divided into three main subcategories: EB-1A, EB-1B, and EB-1C.

1. EB-1A: Extraordinary Ability

This category is designed for individuals who possess extraordinary ability in the sciences, arts, education, business, or athletics. You must show sustained national or international acclaim and that your achievements have been recognized by experts in your field through extensive documentation.


Key features:


  • No job offer or employer sponsorship is required—you can self-petition.
  • You must intend to continue working in your area of expertise in the United States.


To qualify, you can either:


  • Provide evidence of a one-time major internationally recognized award (e.g., Nobel Prize, Pulitzer, Oscar, Olympic Medal), or


  • Meet at least 3 of 10 USCIS criteria, such as:


  • Receipt of lesser nationally or internationally recognized prizes/awards
  • Membership in associations requiring outstanding achievement
  • Published material about you in professional or major media
  • Judging the work of others in your field
  • Original contributions of major significance
  • Authorship of scholarly articles
  • Artistic exhibitions or showcases
  • Leading/critical role in distinguished organizations
  • High salary or remuneration
  • Commercial success in the performing arts


Comparable evidence may also be submitted if the standard criteria do not readily apply to your field.

This subcategory is for those internationally recognized as outstanding in a particular academic field.


Requirements include:


  • At least 3 years of experience in teaching or research


  • A job offer from a U.S. university, institution of higher education, or private employer with at least 3 full-time researchers


  • A tenured/tenure-track teaching position or comparable research role


  • Evidence of international recognition (e.g., major prizes, membership in prestigious associations, published material about your work, judging others' work, original research contributions, or authorship of scholarly books/articles)


Employer sponsorship is required for this category.

3. EB-1C: Multinational Managers or Executives

2. EB-1B: Outstanding Professors and Researchers

This category is similar to the nonimmigrant L-1A visa but leads to permanent residency. It applies to executives or managers transferred from a foreign affiliate, parent, subsidiary, or branch to a U.S. entity.

Key requirements:


  • You must have been employed abroad for at least 1 year in the 3 years preceding the petition (or most recent lawful U.S. admission) in a managerial or executive capacity


  • The U.S. employer must have been doing business for at least 1 year and have a qualifying relationship with the foreign entity


  • The U.S. position must be in a managerial or executive role


Employer sponsorship is required.
