EB-3 Visa - Employment-Based Green Card

What is an EB-3 Visa?

Who Qualifies for an EB-3 Green Card?

Who Qualifies for an EB-3 Green Card?

At our firm, we help U.S. employers and talented foreign workers navigate the EB-3 green card process every day. Whether you’re a business owner looking to retain key talent or a skilled professional ready to build a permanent future in the United States, the EB-3 category offers one of the most practical and widely used pathways to lawful permanent residency.

The EB-3 visa is designed for skilled workers, professionals, and other (unskilled) workers who have a full-time, permanent job offer from a U.S. employer. Unlike some employment-based categories, EB-3 does not require advanced degrees or extraordinary ability — just a genuine job opportunity and the employer’s willingness to sponsor.

Here, we break down everything you need to know: who qualifies, what the requirements are, the exact step-by-step process, current 2026 timelines, and how our team makes the journey smoother.

The EB-3 preference category includes three distinct subcategories:

  • Skilled Workers — Positions that require at least two years of job-related training, experience, or a combination of both.

  • Professionals — Jobs that require a U.S. bachelor’s degree (or foreign equivalent) as the minimum qualification.

  • Other Workers — Unskilled positions that require less than two years of training or experience (sometimes called “EB-3 Other Workers”).

Important note: All three subcategories require a permanent, full-time job offer from a U.S. employer. Self-petitioning is generally not allowed (except in very limited Schedule A cases).

The EB-3 Green Card Process: Step-by-Step

For the Employer:

  • Demonstrate the ability to pay the offered wage.
  • Conduct a good-faith recruitment process to test the U.S. labor market (no qualified, willing, and available U.S. workers found).
  • File and obtain approval of a PERM Labor Certification from the Department of Labor.

For the Foreign Worker (Beneficiary):

  • Meet the exact education, training, and experience requirements listed in the PERM application.
  • Have a valid job offer for a permanent, full-time position.
  • Be admissible to the United States (no serious criminal or immigration bars).

The EB-3 Green Card Process: Step-by-Step

The EB-3 journey typically involves four main stages:

  1. Prevailing Wage Determination (PWD): The employer requests a prevailing wage from the Department of Labor (DOL). This ensures the offered salary meets or exceeds the average wage for the occupation and location. Current timeline (2026): 4–8 months.
  2. PERM Labor Certification: The employer conducts mandatory recruitment (newspaper ads, job postings, etc.) for at least 30–60 days to prove no qualified U.S. workers are available. After recruitment, the employer files Form ETA-9089 electronically via the DOL’s FLAG system. Current timeline (2026): 16–17 months for adjudication (plus earlier steps), for a total of approximately 20–30 months in many cases. Audits can add 3–6+ months.
  3. Form I-140 Immigrant Petition: Once PERM is approved, the employer files Form I-140 with USCIS to prove the worker qualifies for EB-3. Premium processing is available (15 business days for a decision). Current timeline (2026): 5–14 months standard; 15 days with premium processing.
  4. Final Green Card Stage
    • If already in the U.S.: File Form I-485 Adjustment of Status (once priority date is current).
    • If abroad: Consular processing at a U.S. embassy/consulate. Both include biometrics, interviews, and medical exams.
