  • Direct (Standalone) Investment: You invest directly into your own new or restructured U.S. business (e.g., a restaurant, factory, or startup). You control the project and must prove direct job creation.


  • Regional Center Investment (Most Popular!): You invest through a USCIS-approved Regional Center — often in large-scale projects like real estate, hotels, or infrastructure. Job creation can include indirect jobs (up to 90%), making it easier and more flexible. Perfect for hands-off investors!


Bonus: Special visa set-asides (rural areas = 20%, high-unemployment areas = 10%, infrastructure = 2%) give faster processing priority!

 You must invest capital that’s “at risk” (no guaranteed return) from lawful sources:


  • $800,000 in Targeted Employment Areas (TEAs — rural or high-unemployment zones) or qualifying infrastructure projects


  • $1,050,000 in standard (non-TEA) areas


(Note: Amounts are locked until January 2027, when inflation adjustments begin.)

1. File the Petition — Submit Form I-526 (standalone) or I-526E (Regional Center) to USCIS with proof of investment and job creation plan.


2. Get Conditional Green Card — Once approved, adjust status (Form I-485) if you’re in the U.S., or process through a U.S. consulate abroad (DS-260). You and your family receive conditional permanent residency for 2 years.


3. Remove Conditions — 90 days before your 2-year anniversary, file Form I-829 proving the investment was sustained and the 10 jobs were created. Approved? Full permanent Green Card!


Timeline tip: The whole journey can take 2–5+ years depending on visa availability and processing, but concurrent filing options can speed things up.

  • Invest the full minimum amount in a new commercial enterprise (for-profit business formed after Nov. 29, 1990, or restructured/expanded).


  • Create or preserve 10 full-time jobs (35+ hours/week) for U.S. workers (citizens, green card holders, etc.).


  • Prove the funds are yours, lawfully obtained, and truly “at risk.”


  • For direct investments: Show active involvement in the business.


Path to Citizenship: After 5 years as a permanent resident, you can apply for U.S. citizenship!
